This policy outlines the personal information handling practices of the Legal & Commercial Recoveries Group of Companies in Australia also to be referred to as “The Group”

Legal & Commercial Recoveries Group and the National Default Registry is an independent organization responsible for the listing, mediation and reconciliation of any hire or service default larger that $20.00. Subscribing Group Members access the National Default Registry at the time of the membership or service application and utilize the mediation and legal services for reconciliation of defaults once all normal processes or recovery have been exhausted.

Subscribers to The Group and the National Default Registry range form Video and Game Hire outlets, Veterinary Surgeons, Mobile Mechanics and Communications and Internet Service Providers.

Our Commitment

The Group’s Privacy Policy is provided so as to demonstrate our respect for your right to privacy and to assure you that the privacy and protection of your personal information collected through this site and other sources will be kept strictly confidential and held with the utmost due care.

Sources of Information

The Group collects business and personal information relating to the individuals from a range of sources such as Video hire application forms, ASX, ASIC, business names database, the media, credit publications, clients, third parties and publicly available information and publications.

Obligations under the Privacy Act

The Group is also subject to the Privacy Act 1998. The Privacy Act contains a set of standards for the handling of your personal information known as the National Privacy Principles. These principles set out the standards for the handling of your personal information that we must meet.

They require the group to:

  • Only collect personal information about you that is necessary for the recovery of debt, accounts receivable, financial and credit management, credit risk assessment or to meet any legal obligations imposed on The Group.
  • Use only fair and lawful methods to collect personal information.
  • Collect personal information directly from a client, subject or debtor if it is reasonable and practicable to do so.
  • At the time The Group collects personal information from the client, subject or debtor as soon as possible afterwards, we will take reasonable steps to make a client, subject or debtor aware of:
    • Why we are collecting information about them
    • Who else we might give it to; and
    • Any other specific matters.
  • Take reasonable steps to ensure the client, subject or debtor is aware of any other information The Group collects even if The Group had collected it from someone else (a third party).
  • Take seasonable steps to ensure that the personal information that The Group collects or discloses is accurate, complete and up to date. The client, subject or debtor has the right to correct information.
  • Take reasonable steps to protect the personal information about you from misuse and loss and from unauthorized access, modifications and disclosure.
  • Take reasonable steps to destroy or permanently de-identify personal information that The Group no longer needs for any purpose for which we may use or disclose the information.
  • Provide advice in a short document that sets out clearly the express policies about the way The Group manages personal information and make it available to anyone who requests it.
  • If any individual asks, The Group will take reasonable steps to let the individual know generally, what sort of personal information we hold, what purposes we hold it for, and how we collect, use and disclose that information.
  • If an individual asks, we must give access to the personal information The Group hold about the individual unless particular circumstances apply that permits us to the extent to which we give access, namely, these include emergency situations, legal requests from law enforcement and other public interest.
  • If it is lawful and practicable to do so, The Group will give individuals the option of interacting anonymously with us.
  • Only adopt, use or disclose an individuals Commonwealth Government Identification if particular circumstances apply that would allow us to do so.
  • Only transfer personal information overseas in particular circumstances and to the country to which the information is being transferred has similar privacy standards to protect your information.
